Due to spouse's physical/mental issues, he never let me know what was going on. It was a surprise to me when suddenly I was being garnished.I don't know that the debt was ever mine, is there any recourse now?I have become immensely smarter and braver in these credit issues, a year ago I was scared to death. There are 2 TL's for the item, one for the judgement and one for the OC.Can I DV the OC now? and the CA? I have already tried it with the law firm, the said go to the court and get the records. Normis Debtor Posted December 5, 2006 Report Share Posted December 5, 2006 You would have to file a motion to vacate the judgment before the garnishment order could be revoked.Good luck convincing a judge it's not yours when:1) You didn't defend the claim in court after being served2) You were notified in advance of the garnishment proceedings and failed to contest them.3) You've been paying towards the judgment for a year Link to comment Share on other sites More sharing options...
