pamelabe Posted December 5, 2006 Report Share Posted December 5, 2006 What do you do when the Magistrate Ct voluntarily dismisses without prejudice on a civil action and the debt collector of Mann Bracken continues to tarnish your record and continues to call to collect the debt??? The debt collector (Mann Bracken) has been informed of the legal copy of dismissal by us but will not back off let alone recognize it. This dismissal was documented July 2003! In law, the phrase without prejudice means that a claim, lawsuit, or proceeding has been brought to a temporary end but that no legal rights or privileges have been determined, waived, or lost by the result. They can sue again based on the same claim if they want, so they didn't really lose. How did you get the case dismissed? Maybe some others can help more with a tad more info.Thanks, and good luck!
