therealdeal
Hello all. I unfortunately filed for BK in 2005. I purchased a 3 in one CR this month to begin the repair process and I just was curious if the discharged debts are to remain or are they to be removed? LNY
Hello all. I unfortunately filed for BK in 2005. I purchased a 3 in one CR this month to begin the repair process and I just was curious if the discharged debts are to remain or are they to be removed? They remain, for 7 years, unless you dispute them off (like if they contain errors). The items will read either "included in Bankruptcy" or Discharged in Bankruptcy." Known as "IIB" accounts around here.
therealdeal
The thing about this though is that no of them state included in BK. So now what?

LadynRed
Every debt included in the BK should be noted as such as LNY pointed out. They should also show a ZERO balance, and NOTHING past due. There should also be no lates or charge-offs showing with dates that were AFTER your BK filing date. There should also be no collections showing on any discharged debt. Creditors/accounts that were charged-off and/or sold prior to your BK filing may not get changed to IIB as they had already washed their hands of the debt. Methuss
Creditors/accounts that were charged-off and/or sold prior to your BK filing may not get changed to IIB as they had already washed their hands of the debt.Been through this dog-and-pony show once before. If it was charged off prior to the BK, they must still list it as included in BK if it was on your schedules. As we all know, charge-off accounts are nothing more than an accounting term and they get sold or transferred 99% of the time. If it was included in the BK it must be noted as such so it is clear the debt is discharged.
LadynRed
Right.. tell that to the creditors who you will have to sue to make them change a debt they got rid of sometimes years prior to a bankruptcy !
Methuss
I didn't bother with the creditors. I went straight to the CRAs. A copy of the discharge papers and a redacted schedule showing only what I wanted them to fix was all it took. Not a single one ever was a problem after that. If it had been, I would have gone after the bureau.
