Copy of Statement a Year Later

I'm not quite sure where to begin, so please bear with me.

A year ago I received notice from Palisades Collection in PA that they had purchased two of my accounts. I sent them DV letters at that time and received green cards back from them. They responded with letters acknowledging that I disputed the debts, and they stated validation could take up to six months. At the time, I did not notify the CRAs because I didn't know to do that. (the person who told me to send the DVs didn't say anything about notifying the CRAs)

It's been a year since I received those letters, and today in the mail, I received a letter from them with a statement on the account from January 2004, stating that they consider the debt to be validated.

I hadn't thought about this since last year and because I hadn't heard from them. I'm not sure what to do next. The accounts were opened in NV, so there is a year left on the SOL (although I currently live in MS).

Any advice is greatly appreciated.

A letter from THEM saying THEY consider the debt valid? Interesting. Was there a statemnt or anything from the OC? If not, they may be a little lacking on the validation information. Palisades is a typical JDB...they never seem to do things by the law. You may just go ahead and dispute with the CRA's to see if you can get the TL's removed. BTW, the SOL that applies is the SOL for the state you currently live in, MS, which I also think has a statute of repose that extinguishes the debt after the SOL is up (the debt doesn't legally exist). You may want to start keeping track of the violations to help get leverage to negotiate with.

The statement included was from the OC. Sorry for not clarifying that.

If the SOL is for the state in which I currently reside, it may already be up. It was last reported in Jun of 2004, with the last activity on the account in Dec 2003.

I've been keeping up with my credit report, and there doesn't appear to be anything from Palisades on it...just the OC entries.

You probably should dispute with the CRA's, sounds like the OC passed the debt off and won't bother to verify. The TL's may come off but Palisades may try to stick them on later. If the SOL is up in MS then there is legally no debt. Check to make sure the SOL is up and then fire off a cease and desist letter to palisades, maybe let them know about your state's statute of repose also.

If the state of current residence is the SOL that applies, then the SOL is up (Dec 2006 was three years). Where do I find out about the statute of repose?

Before disputing with the CRA's I would make sure the only addresses on the CRA reports are MS. Dispute the other ones off. They almost always delete the old ones. This may help when you dispute the collections.

So, I contact the CRAs and tell them I want my old addresses removed? To reflect my address here in MS? (I'm sorry...just trying to figure out how this all works)

Yes. But word it a way that makes it sound as if you never did live at any of the old address, even though you may have.

I've lived here for 12 years.

Kansas, I've never lived in Kansas...

I also just received some documentation from Palisades in response to a DV i send over a year ago! They are not showing up on my CR and never have. Should I just sit back and see if they do anything else? By the way, the "documentation" included two OC statements from early 2005 and a computer print-out showing account details from the OC.

Do they process these things in batch or what?
