Guest helpneed
If a CA has listed the name of the hospital on my CR, is that a violation of the following and how much is the violation worth?-----------------------------------------------------------------§ 605. Requirements relating to information contained in consumer reports [15 U.S.C. § 1681c](a) Information excluded from consumer reports. Except as authorized under subsection ( of this section, no consumer reporting agency may make any consumer report containing any of the following items of information:(6) The name, address, and telephone number of any medical information furnisher that has notified the agency of its status, unless--(A) such name, address, and telephone number are restricted or reported using codes that do not identify, or provide information sufficient to infer, the specific provider or the nature of such services, products, or devices to a person other than the consumer; or
Recovering Attorney
IMO, having the hospital name is not a violation
direred
The hospital name IS a violation, that's one of the points of the FACT Act amendments. One of the entire points was so that third parties wouldn't see places like "Cancer Centers of America" on your CR and deny you credit due to a presumed medical condition (especially in the case where the medical collection was in fact for a child). However, it will be on CRs that you pull directly from the CRA so that you can contact the CA in question. sr28b
FACTA changes for reports created for employment purposes or in connection with a credit or insurance transaction... An agency may furnish medical information that pertains solely to financial transactions so long as the agency ensures that the information does not disclose the specific provider of medical services or the nature of such services. So what should I do next, send an ITS letter? stating what? can you help me with this? 2. Do I write the CRA informing them that it is a violation and ITS if it's not removed.3. Do I contact AG?Thanks
direred
1) It shouldn't be on a third-party CR (e.g. from MyFICO.com).2) It may (must, actually) be on a report directly from the bureau.Where did you get a copy of the report that showed the medical provider name? Guest helpneed
I received mine directly from the CRA. If creditor's or employers pull my report will the hospital name be visible to them as well? And if so, isn't that a violation?

This isn't true for a lot of facilities, thus the law.Remember, employers are known for not hiring people due to medical insurance concerns. The entire purpose of the medical provisions to the FACT Act was about having credit reports comply with HIPPA.
