mjstallion Posted January 24, 2007 Report Share Posted January 24, 2007 I sued Equifax for several FCRA violations about a month ago, and now I've found out they've frozen my account, meaning there are no updates. I called them and they said that customer service can't talk to me because I'm in litigation with them, and only their attorneys can talk with me.Is there anything I can do to get them to update my report? Also, I haven't heard anything from their attorneys yet regarding my lawsuit, how long does it typically take for them to call you to try and settle? direred Posted January 25, 2007 Report Share Posted January 25, 2007 You can order a copy of your report (with a check) through their attorneys.This was a huge point with Spector v. Methuss Posted January 25, 2007 Report Share Posted January 25, 2007 There is no provision of law anywhere that allows the CRA to "freeze" your credit report because you've sued them.As a matter of fact, the FCRA specifically makes an action of locking you out of your credit report for any reason not allowed under the Act to be a violation of law. My score watch was also cancelled a couple days after and they did not refund me the unused portion of the fee. Equifax.I had been subscribing to Equifax Credit Watch Gold on their free trial, which allowed me to pull my report once a day, but the problem was the report would never update. I had three additional tradelines show up on EXP and TU, but Equifax didn't put them up. I called Equifax and they told me that my file had been locked because I was in litigation with them, meaning that my report wouldn't be updated.So if I ordered a report through their attorneys, would I get an updated one?
