How do I deal with Midland Collections?

They have two accounts of mine.

Acct #1

CA: Midland Cred

OC: Discover

Date Assigned: May 2002 (they bought from another CA- the OC gave up in 2000.

Date Reported: November 2006

Amount: $1988

Balance: $3585

Date paid out: Not on record

Date Closed: Not on record

CA: Midland Cred

OC: Associates (Not sure who the hell this is)

Date Assigned: May 2005 (they bought from another CA- the OC gave up in 2000.

Date Reported: November 2006

Amount: $922

Balance: $1479

Date paid out: Not on record

Date Closed: Not on record

how should i handle these? I have the $ to pay them off- but I dont want to re-age these accounts either.

From the information you have provided, it would appear that the SOL has expired on these acccounts. Midland is fishing for suckers. Don't be one.

If these are repurchasers aka JDB's, the FL AG maintains the stance that repurchasers are not regulated by the state. At this time it looks like anything to do with JDB's will need to be taken to the Federal level.

I would however, suggest filing a complaint with the FL AG office just so they have to keep thinking about it. Perhaps if they become inundated with complaints about JDB's one of the mindless clerks will get up off their hands and bring it to the AG's attention.

The last thing I want to do is sue them.

They are not bothering me, I am not worried about them sueing me, I am just looking for the easiest way to get them off of my report.

Are you guys saying that I need to sue them to get rid of it. Wont the CRAs delete it under the SOL?

This is not just for you, it is for everyone who enters the credit repair journey. The credit repair process that is advocated here on this site uses the CA's and OC's violations of the FDCPA and FCRA (as applicable) to build a case for a potential lawsuit. Everything that you do is a build up to that end purpose. In order to be effective, the CA or OC must have a reasonable belief that you plan on following through with the percieved threat of a suit. Most (not all) of all CA's and OC's will delete and go away long before you get that far.

For the ones who do not, it is up to you to decide whether or not you want to take that next step. Sometimes you have to sue, or live with the credit hit.

I understand your point and appreciate your response. However, from my perspective these debts are 7 years old so if they are going to fall off this year I can be patient- I mean heck the last 7 years has been rough, so I have tough skin!

With that said- how do I determine when these will fall off? Can I call the CRAs and ask or is this a vodoo magic type process like so many others in the world of credit?
