I had a collection company Excel Acquisitions LLC that bought a old debt that was over 14 years old and posting a fraudulent opening date to the credit-reporting agency (Equifax) in order to try and collect on. I had bought a new home back in November of 2005 and because of this derogatory posting on my credit report I had to get a second loan for 36,000 @ a intrest rate of 9% in order to buy my new home. I wrote letters and letters to all concerned parties and after 11 months of letters Equifax the credit-reporting agency finally removed this derogatory posting from my credit report. As a result from all this I’m stuck with a second and this headache caused me to have a heart attach. I also would like clarification if this is legal or not.If a CR has a collection TL showing with an opening date later than the dola, is this inaccurate, and should it be addressed? I feel this is a good case but on the outher hand I've been sending and posting emails now for awile and I'm wondering now if there is anything legal I can do. But if he gives you some instructions to follow you had better be very polite to his staff. Also if he says he can help you with a foreclosure problem you had better get all your ducks in row if bankruptcy is anywhere in the picture. Make sure that is all out if the way because he will not do anything for you until he is sure he will be paid. I am not saying that that is anything but good business, but if your situation is down to the wire he will not assist you until that pesky bankruptcy thing is out of the way. That includes taking the class before you file and paying for that and retaining the attorney and paying the filing fee. What connection is there between the second loan and the bad tradeline? Did you already have a first mortgage? Wasn't that enough?
