artistic Posted January 28, 2007 Report Share Posted January 28, 2007 Please don't yell if the answer to this is already here... I have looked and searched for the last several hours to no avail. I did find one post that looked promising but all the links were broken. I live in Oklahoma and would like to file suit under the FDCPA against a collection agency and also the credit bureau for failing to removing items among other things. I cannot afford an attorney and will do this myself. What court has jurisdiction in something like this? I've looked up the State and District court websites for Oklahoma and found nothing about doing this without an attorney. I also saw several posts about things bouncing from state to federal court??? That includes your state and county courts as well as the federal system. But, if you file a federal claim in state court, your adversary has the right to request the case be moved to federal court. I thought I was fairly intelligent but all that legal speak just gave me a headache. I have almost the same situation you had.... Ignoring my requests for validation, reporting the wrong amounts owed and then verifying the highest amount back the CB. Calling me at work after I asked them to stop, threats, etc. One even left a horrible rude message on my answering machine calling me names and cussing! (yes i still have the tape)I already work three jobs, I can't see where I'd find the time to learn to be an attorney too. Is filing in County or State court easier if you are doing it on your own?
