SparkyPA
hi, im being sued for a credit card and I would like to know if I can use the SOL as my defense. I see in PA were I live its 4yrs. So my question is, If the debt is past 4yrs old then can they sue and get anything? Or has the time passed for that? Im almost def my last payment on the account was over 4 yrs ago. Thanks for any info you can give me
nascar
If your timeline is accurate, you may be able to use SOL as an affirmative defense. You MUST assert it in your answer, or you'll lose the right.
IHateCAs
As long as the date of breach >= 48 months from the time the lawsuit was filed (or maybe served on you), SOL is a viable defense.
