Is this response sufficient for summons??? got to mail....

I am trying to do this myself......got to get sent tomorrow. Is this

sufficient for a response of denial? Does it say too much? not enough?

should I ask for a dismissal or wait on that and just respond with denial at this point...don't know court date, yet.. I know they don't have a case... ... still stressing.

Response to summons from Midland Funding LLC,

Plaintiff vs. Janis A. xxxxxx, Defendant

no: 2006-xxxxx in Circuit court of Marion County,

Mississippi

I, Janis A. xxxxxx, deny that this debt on the complaint issue to me by Midland funding is my debt.

1. I deny ever having an account with this

number with First North America Bank.

2. I deny the dates on the exhibit entered

( account interest free from Oct.1993- till

April 1994.) I had not applied for credit in

my name . All credit was in deceased

husband’s name.

3. According to the Statue of Limitations in

Mississippi and the dates on the Affidavit

it would be past the 3 year period.

I dont understand, you have a summons to go to court, then go to court and set the date and then go to court and DENY IT , unless they can prove anything, they do not have a case, go to court and set the date and then worry about fighting it, you have a summons to appear, then appear, I am not an attorney but this maybe a suggestion to consider

I only have to respond by writing to the summons at this time.

Summons reads "you are to mail or hand deliver a written responds to complaint to attorney and clerk of the court within 30 days or a judgement of default will be entered against you."

So that is what I am trying to do...would like to think it would never get to court.

Your response is fine then, i see your deceased husband was card holder bottom line, Its not yours ! Goodluck !
