saturnwings Posted February 2, 2007 Report Share Posted February 2, 2007 I know this pairing has been hashed before, but I just wanted to ask a few things since the guy I spoke to on the phone was actually quite cordial and not rude like I had expected from all the info I've read on ACS.Anyway, I just got off the phone with a guy from ACS. They used to have an old address of mine, so when they sent the letter regarding the debt initially (dated 12.19.2006), I didn't get it until late that month. By the time I was home and sane enough, my 30 days had passed, and I couldn't send a DV (can I?). When I talked to ACS just now, he said he now has my current address. Can I still send a DV on the basis that the last letter sent was a letter I didn't get?Second, my problem here is that I just graduated from college. I had a few credit cards that my parents paid and were reserved just for school stuff. The guy told me that this looks bad for me, and that Citi was likely to sue because it appears that everyone is getting paid except them. (This can't be true since I had 3 credit cards that I paid myself when I was in school, and I'm in trouble with all of them. Citi is the only one sending things to a CA, but the other two aren't getting big bucks or money on time, and that should appear on my credit report - actually, the business Capital One card I had should've been charged off by this point, so I'm not sure what crap this guy was spewing.) In any case, the original point was a logical and valid one, and I'm wondering if, maybe, Citi would actually sue. (From what I've gathered on this board, Citi does seem to be litigiously inclined.) What do you think?I am very afraid of getting sued, but the very basic point comes down to the fact that I have no money left at the end of the month to pay the $3000 settlement ACS offered - he offered a payment plan of $100/mo if I could pony up $1300 initially, and I can't do that, either. I'm barely keeping up with my students loans and utilities as is. Is garnishment of wages is simply something I should look forward to if/when Citi finally sues me? Is there any other option for me? If it is legal in your state, record their calls and/or take notes. Are they using the term "docket number"? Pay special attention to their tactics and wording.
