The location that I joined eventually closed and was bought out by Gold's Gym. My membership was converted to Gold's on a month to month basis or so I thought. After pulling my credit a couple of years ago I noticed Bally's reported me as charged off for $1400. I called them to inquire about this and they told me a CA was handling this now and that I had to deal with the CA. I called the CA but that was a waste of time, the guy was rude and I lost my cool and cussed him out. I never followed up on this again, and now its hurting my ability to get a house. The account is now with a different CA which I disputed online and of course it came back as verified. My big problem is that I have no paperwork showing that my account was converted from Bally's to Gold's and I have since cancelled my Gold's membership and they don't have my file anymore. I'm thinking what I should do is DV OC and maybe CA in the hopes that their record keeping was as bad as mine (they did shut down my gym and all). Then if they do verify, try calling OC and seeing if they will remove since they shut down my gym. Any advice or suggestions would be appreciated. Thanks. Is there another Ballys near where you live say within 20 miles? I know they have some dumb policy regarding distance. You are right. IMHO I would DV them and if they verify the account I would send letter telling Ballys (if they still own the account) that I will sue if they did not remove the account since the closed the gym so they did not hold up their end of the contract. You cant pay for a service you cant use. Of course this is all providing there isnt a another Ballys near by.Maybe some one who knows contract law can chime in and let you know if you have a leg to stand on. I moved away from AZ to VA and my commute to the nearest Bally's went from 5 miles, to about 18. However, the 18 mile drive would take about an hour due to the cities congestion so I wanted to cancel. They would not let me so I just stopped paying. One day I got served for suit and when I answered my suit, I basically asked for debt validation (btw, it had been close to 5 years before they sued me). About a week later, the case was dismissed by the plantiff. I'm pretty sure they just couldn't validate it since AZ law allows 6 years before the SOL. JohnnyC24 Posted February 8, 2007 Author Report Share Posted February 8, 2007 ok, so I disputed Bally's with TU & EXP and according to the person from TU that I spoke with yesterday they have until Monday to respond or it will be removed from my report. There is a CA on my report claiming that I owe them for this account as well and they did verify according to TU. Should I go ahead and send them a DV letter now? I sent off DV letter to the CA that is handling the account for them. Why would they say this is paid on the credit report now? I hear that Equifax reports include the information needed to discover DOFD. I use TrueCredit and have discovered that if you start an online investigation, there is a screen that shows "estimated time to expire from file" or something to that affect. JohnnyC24 Posted February 25, 2007 Author Report Share Posted February 25, 2007 I got a response from the DV letter I sent to the CA (professional recovery systems) and basically it said they received my letter and a full investigation is being instituted. It said it can take anywhere from 30 to 90 days to obtain and that they will send me a copy of the info once it is obtained. I thought they only had 30 days to do this? How can I check if it has been re-aged or not? The only one the OC (Bally's) is reported on is TU, CA reports on TU & Experian. divemedic Posted February 25, 2007 Report Share Posted February 25, 2007 1 There is no time limit for the CA to repond to a timely DV, they just have to cease collecting2 That looks like reaging on the part of the CA. both TL's must fall off at the same time.
