SparkyPA
Hi, I have talked about this on another thread but I have a different question. I just got my credit report in the mail and the credit card Im being sued over has the date closed as 04/2002 and the SOL in the state I live in PA is 4yrs so can I use the SOL as a defense? Also I found odd is that under PAY STATUS it has 30 days past due and I have not paid on this account in yrs. Thanks in advance
rella5
I am replying to you in the spirit of helping you, though I have no expertise. I would like to suggest that when you post a question always use a title that tells the viewer what it is you need help with. The experts and "gurus" all volunteer their time and they might answer faster if they know the subject.I understand you're probably frazzled and confused and you just need a fast reply because your brain is on overload but frequently the answers are all over this site if you just take a deep breath and devote some time and concentration on researching. Again, I mean this reply strictly in the spirit of true empathy and help.
CarolinaBlueEyes
Do you know when your last payment was Your SOL is based on you DOLA or your last payment, whichever is most recent.. some judges allow CR some don't but if you feel its an affirmative defense then go for it..they will have to prove that the last payment or activity was not within the SOL
