How can you find out the original debt date and not the one reported on credit report. The reason I asked is because I had a Lane Bryant bill in 1995 and it is still showing up on my report as 2001. It is owned by the same company. I disputed it and the CRA took it off and now it is back on there again. Can someone please tell what can I do? Second QuestionI am still not understanding the SOL. It is really confusing to me. Can someone give me the Dummies versiion of SOL? 3rd QuestionI have a lot of medical bills on my credit report. How can I dispute them and/or write a settlement letter? How much should I offer to pay them? Some of the bills are my children's and mines? I just want to get my credit back good. I am really thinking about doing bankruptcy. I noticed when my friend did it; he was offered a lot of stuff including refinancing his house.Anyway send me any websites/sample letters or anything that can help me? Southerngirl Posted February 9, 2007 Report Share Posted February 9, 2007 I by no means am as experienced and knowledgable as many here are, but I will take a stab at some of your questions.First off if I understand you, your Lane Bryant account was deleted from your CR and now has been reinserted after DV the same company regarding another account. If this is correct, that is a no no. There cannot be a reinsertion of an account that has already been deleted without the Big 3 contacting you first. I would write a letter to a 3 CB asking them to delete from report due to reinsertion. You of course would word it differently, but let them know that you know your rights.The Statute of Limitations in SC is 3 years. What that means is that a CA/OC cannot sue you for a debt that is past 3 years. Now, they can continue collection efforts, letters,phone calls, but are not suppose to sue. You will see in many posts that JDB will try to sue anyway if that happens you must answer the summons and show up to defend yourself in court if it gets that far. Medical Bills- Send a DV for all of them, be sure to send CRRR keep good records and see if they respond. You don't want to offer settlement until you know if it is your bill and the charges are correct.Bankruptsy- This depends on your financial state. How much debt you have, if your employed and if you want your credit ruined for 10 years. As far as your friend I don't think you have the whole story. Bankruptsy is not a picnic and depending on your income you might have to pay all your debt back with large payments for the next 5 years.I hope this helped, If I have given incorrect info please chime in anyone and steer her in the right direction. If it WAS in 1995, then whoever re-inserted the debt has illegally re-aged it. Negative information can NOT be reported for more than the 7-1/2 years from the date of first delinquency (about 30 days after your last payment to LB). Dipute it - again, as illegally re-aged and OBSOLETE. SOL - SOL in SC is 3 years. What that REALLY means is that you have an affirmative defense to have any lawsuit they may file thrown out based on the expiration of the statute of limitations. The SOL does NOT prevent them from suing you. SOL starts when you first went past due - and you never paid anyone a single penny more. So, if you quit paying before 2004, the SOL has expired. You dispute medical bills the same way you dispute any other debt - you DV whoever is collecting and ask for proof. If they prove it.. The point of bankrtupcy is a fresh start. If you don't modify your spending and credit habits, bankruptcy won't help you a whole lot - you'll just wind up drowning in debt again later. Bankrutpcy DOES NOT 'ruin your credit for 10 years'. Yes, BK is a huge hit, but if you've already got a lot of bad debt, it's not going to be big decline, in fact, it may RAISE your scores. It is proven that you can recover from bankruptcy faster than you ever will waiting for old debts to drop off and constantly fighting with collectors who illegally re-age debts. With careful rebuilidng and credit repair post-discharge, you can bring your scores up enough to qualify for decent rates and a mortgage.It's an individual choice. You'll get a card back proving that the mail was delivered. Yes it was delinquent in 1995 but is showing up on credit reportDid you make any payment after that time? A promise to pay or a payment restarts the SOL clock.The LB account can be attacked as obsolete or as a reinsertion...your choice.
