dsantos31
Hello All,I'm not sure if this should be posted here or in the Credit Repair forums but I have received great info & advice on this forum, I thought I would start here. I filed for BK7 4/2005 (discharged 8/2005) & I'm sure that when my attorney pulled my CR for the filing there were accts not listed as charge offs but are appearing as such on subsequent reports with a balance. I've tried to decipher thru the report the date of charge off but it is not clear. How can I locate the actual dates of charge off to compare with my CR at time of BK filing? In addition, on my report, the "Date Reported" for some accts IIB are showing current reported dates (i.e 02/2007). Can creditors still report although the status states IIB & show a zero balance?I apologize if this question has already been presented to the forum, but I did a search & was unable to locate a similar thread. Thanks in advance for any information & advice.
LadynRed
Creditors can continue to report the STATUS of the account, just as long as they are reporting ACCURATELY. That means it must say "IIB", have a ZERO balance, and show NO negative entries after the date of your bankruptcy filing. If an account was NOT charged-off BEFORE you filed for BK, they can NOT report it as such AFTER your filed - that would be a violation. Read the sticky up top regarding negative reporting on discharged debts. The date of first delinquency is the important date for the reporting period. Charge-off will usually be 180 days after the last payment.
dsantos31
Thank you for your reply LadynRed.I've received valuable info from you & others before & after my discharge. I will view the sticky as suggested.Just one last question on this issue, if an acct was charged off prior to BK filing - can they still report a balance? I know I may find this answer in the sticky, but I thought I'd ask anyway .Thanks again for your advice.
LadynRed
No, they can NOT report a balance if the debt was IIB, doesn't matter when they charged it off.
