Kirby Vacuums, Preferred Credit

December of 2005 I purchased a Kirby Vaccum from a door to door sales man. I'm sure you guys/gals know these people. they get a good looking 19-20 year old female to come to the door and offer to clean the carpet in one of your rooms. Anyways, I was very impressed with the vacuum and bought one. They offered a "payment plan." Which I now discovered is financing. But when I filled out the "application," I asked if it was financing and there wasn't anything on the form that would make me think that it was. I refused to fill out my social security number and credit history for that reason. The sales person said "No Prob."

Now I am trying to clean up my credit and clear up any small debts. I noticed that there was an inquiry on my CR from Preferred Credit, which is the company that Kirby finances through. There is also an open account from them as well. I disputed the inquiry and they sent me a copy of the "application" that I had filled out. On this form, it appears that the sales person filled in the blank spots that I refused to fill out. It lists the incorrect social security number as well as incorrct payment ammounts on other financed items. I was late on a couple of payments and it is being reported as account past due. Any advice? Since the info is incorrect, should I pay it still or can I just forget about it? and since my info is wrong, can that be reported on my credit report? In addition, the "application" that they sent me as "verification" for the inquiry, does not state that they may pull my credit.

I am a little concerned since I have made payments, does that make me liable for the debt or appear that I am assuming responsibility for the debt? Which I don't mind doing, it's just the fact that I feel like I got scammed. Thanks for your help in advance.

I used to be a Kirby Salesman years ago. I mean years ago! I hate to tell you that the Kirby Distributor buys a Kirby for pennies on the dollar and then sells the Kirby as a Deluxe $1500 to $2000 machine. Yikes! Back in the early seventies the Distributor that I worked for got the Kirby for $50 a piece and then we went out and sold the Kirby for $450 Basic Machine and $750 for the Deluxe full attachment model. The main selling feature was to ask where you bedroom was, and then immediately go back their peel back the sheets on the bed and Vacum the mattress. Wow! A sell everytime because the Kirby picked up all the dead skin that people shed when they sleep. Did you know a person will shed 1/3 of their skin over their lifetime? I believe that if you have been paying on the Kirby then it's your Kirby from then on out. I also think in the application process they gave you a 3 day recission notice and that would apply towards your purchase of the Kirby. Do you remember any of that stuff during the signing process?

I asked around a little bit, and it seems that is the common factor. I din't remember that. The copy of the application that they had sent me does state that though. Which I don't have any problem paying. But what I signed does not state anything about reporting to the CRA's or requesting credit reports.

I don't think you can make a case for the salesperson putting fake info on the contract, if you signed it with blank spots...well, that was kinda dumb. Should have struck through them with a pen.

The fact the contract said nothing about pulling your credit - I wonder about that. You did ask for financing, is there a law stating they need your explicit written permission to pull? I'm not sure.

I know that I should not have signed with blank spots. I guess I was thinking that it was personal information and they wouldn't have that info anyway. Also it was 10PM by the time they were finished with their little demonstration and I was ready for them to get out of my house.

You signed the application - you are responsible for the debt. The sales person entering info you refused to supply is just wrong, sorry. While you shouldn't have left it blank, they should not be filling in bogus information either.

I had a young man come to my home about 15 years ago sellling Rainbow vacs. I knew they had a problem with the seals, so I had no intention of buying one, but a 'friend' gave him my name and she supposedly got some kind of 'credit'. Sooooo.. when they wanted to clean something.. I let him clean the couch cushions -- one of which the cat had peed on earlier in the day and I'd cleaned already. The look on his face when I told him it had been cat pee (he was sticking his fingers in the suds) was priceless !! LOL
