ronn
I am expecting a 2300 refund for 2006, when I "surrender" this to the trustee. Does that get applied to my balance of 21330 or is it in addition to my balance. Thanks in advance.
thomassl
I would contact my bankruptcy attorney. When I had my Chapter 13, I needed my tax refund and wrote a letter to my attorney to send to the bankruptcy administrator each year I filed. I was able to keep my return. I justified my reasons in my letter.
ronn
Thanks. Just trying to get some input, since I feel my attorney did not get me the lowest possible repayment plan.
ronn
The tustees office stated the tax refund is in addition to my plan payments, my bk attorney said it is applied toward my plan and just causing my plan to end earlier. What should I do? bingo
Follow the trustees instructions or, risk having your bk dismissed.
LadynRed
Yes, you really don't have much choice in the matter. However, if you have to have some of it, a critical need, you might be able to appeal to the Trustee.
momof5
My refunds and my brother's refunds were kept by the trustee and shortened the repayment period. If you are smart, you will go to your employer and up your deductions so that you get more in your regular paycheck.
