Nikro Posted February 24, 2007 Report Share Posted February 24, 2007 My DH has 2 charged off Capital One accounts on his CR. According to EQ they are due to drop off 12/07, so they are OLD. We did receive a dunning letter from C1's CA this past October, sent a DV letter---they replied that when they get the information they would let us know. We haven't heard anything since.For my ?---Do you think they will sell these accounts before December so he gets another neg on his report? crystal_roses Posted February 24, 2007 Report Share Posted February 24, 2007 What state do you live in, and what is the statute of limitations on credit card debt?If you have passed to sol, I would dispute them with the CRA's now as "obsolete" and see if you can get them off early! Otherwise, just wait it out until December. If they sell it to another CA, DV them within 30 days of their first contact with you. Chances are, if the first CA can't validate, the next one won't be able to, either.Also....if this debt is out of SOL, and you are contacted by another CA, just send them a C&D letter and tell them that you know this debt has passed the SOL. Check your state laws about collecting on a time barred debt. In California, they aren't supposed to even try.Good luck, and of course, all of this is just my 2 cents!
