naia
I received a letter from a CA called AFNI a month ago about a debt with a phone company for $6,000 and change. I sent them a validation letter and today they responded, with a photocopy of an old statement from Verizon dated Jan 7, 1999.Additional uncollectible (Writeoff activity) 6493.69-What do I do next? I checked the sticky about checking the CA's which I'll do right away...but in the meantime, what else do I do now? This very high phone bill was due to my phone card being stolen while on a cruise, and used for long distance calls. I had let the phone company know about the situation in 1998 or so, and just gave up because they claimed that since I waited too long to complain then it was my debt.Does the statute of limitations apply? I'm a bit confused with all the information in front of me. Is this an unsecured debt? Where would a phone company fall under? Thanks so much for any advice.Naia
SecretAgentWoman
I sent them a validation letter and today they responded, with a photocopy of an old statement from Verizon dated Jan 7, 1999.They just sent you the best weapon possible. It IS past the SOL (in CA it's 4 years). Send them a C&D letter, make sure it is not reported on your CRs, or if it is, use that statement and letter they sent you to dispute to the CRAs that it is over the 7 year reporting time limit. They can't do a thing to you.
