DV'd and I don't understand the process completely

Recommended Posts

Hi everyone,

I've recently sent off and recieved two of the Big 3 CR's back. After rewiewing this site and my CR's I decided that I wanted to try to clean up my reports so I started the DV process. First thing I did was disputed most of the negative items on my reports with the CRA's to see the results. About two TL's where immediately deleted but the rest of them were verified with an Updated or Remains status (on my Experian report).

Since I immediately disputed most of my TL's I am sure I woke up some CA's that weren't even paying me any attention. To make matters worst, I sent out DV letters w/ green cards to everyone that validated with the CRA's. And finally in my long list of f-ups I signed all of the letters which I just found out was a no-no :(

So I guess my question to all know is, "What should I do from here"? My biggest concern is that some of these pee'd off CA's will try to collected or sue me. So far I haven't recieved any responses from my DV letters and the 30 days is almost up. Any advice on whether I should continue my journey or just try to back out some how?

It doesn't sound like you've done anything terribly wrong. What are the SOLs on the debts for the CAs you might have "woken up"? If you are out of SOL, you really don't have much to lose.

The no signatures rule I wouldn't worry about too much. I don't think it's common practice for them to lift signatures, but it has happened I guess, so people are being super careful.

Try this thread and you will see you are pretty much on the right path. Have you gotten your green cards back from your DVs? If so, it's time to dispute with CRAs again, according to the process outlined.

I'm not sure which date the SOL starts but I'm pretty sure none of them are up because Indiana SOL for written contracts say's 10 years on this forum and I've only been of legal age to enter into contract for 8 going on 9 years. I've recieved all of my green cards back with the expection of one DV letter that came back as Unable to Deliver.

Sounds like the next thing to do would be to go ahead and dispute with the CRAs again. By the way, I read a thread that said that if you continue to dispute TLs on you CR, the CRAs will begin to deem your requests as frivilous.

Indiana SOL's are;

open accounts (credit cards,etc.) six (6) years;

written contract for payment of money (promissory notes, etc.) before 9/1/82 10 years, after 8/31/82 6 years;

written contracts for goods or services 10 years;

domestic judgment against real estate 10 years;

domestic judgment against a person 20 years;

They might, but if you dispute by phone, they will usually take them (except EX, they suck)

Looks like you are doing OK for now.

So since all of the CAs have recieved DV letters and all the green cards have been returned my next step is to get a copy of my CRs for this month? If I recieve let's say my EX report and it's still showing all of these TLs as validated for the month of Feb/March 2007 and I have not recieved validation is this illegal? I'm sure I would need more info than this if I were to start suing which would be very very hard to do with so many CAs. Should I send out another letter to the CRAs or CAs. If so, could you tell me what type of letter and give me a sample.

What kind of debts are they? Credit cards or something else? That makes a difference for SOL.

You need to dispute the listings on your CRs. Then if the CA verifies them with the CRAs without telling them the lines have been disputed, that's where they've gone wrong.

Even if it comes to suing, you won't have to do it all at once. You can break these down into manageable chunks. Don't let it overwhelm you.

I really doubt you will have awakened a whole cadre of CAs to come after you. Even if some do now, you still have rights, don't panic. Read on here and follow all the great advice. No. 1 being stay off the phone, if they call you, tell them to send you a letter and hang up.

Fortunately, none of my debts are CC related. Compared to some of the threads I've read I feel alot better about my credit situation. The biggest debts I have are for a repo and a couple apartment complexes. The repo TL is from Primus Financial and the amount is 8,467. The good thing about it is the TL for this item is scheduled to continue on record until Aug 08, which isn't bad at all. But, they also sued so I have a public record with the same amount posted that will continue until Mar 2010.

Except for the apartments the other debts are relatively small but a few I don't recall and I'm not going to settle on a debt I don't remember. So, once I see that the CAs that I sent DVs to are still updating my CRs as valid do I need to send out more DVs? And if so, how long will I have to do this?
