lyle7289 Posted March 1, 2007 Report Share Posted March 1, 2007 I had a Collection account removed from my CR under collection agency 1. 3 to 6 months later I recieve a collection notice from another collection ageny for this same alledged debt. It is not on my report as of yet. I just recieved the collection notice in the mail. I have thirty days to reply or it will be surely inserted. What are the chances that they will go away once I ask for validation? The first collection agency could not validate so it was removed.....These are from JJ marshall and I just disputed one and whamo..it was removed. I just don't want to take the chance that I can get the same result. I also don't want this to go on my report.Also, does anyone know of a form letter that I can reply to this CA with? lookinup Posted March 2, 2007 Report Share Posted March 2, 2007 You can find form letters on this site (click "debt validation" at the top of the forum), but I have been told by the veterans on this site that you are better off just saying "I dispute this debt." Instead of all the mumbo jumbo in the form letters.I'm guessing if the first CA folded after DV, there probably isn't verification available and this one will fold too. willingtocope Posted March 2, 2007 Report Share Posted March 2, 2007 If you DV before it appears on your CRs, then if they do report it, its a violation of the FDCPA...comes under "continued collection without validation".Also...whether or not it gets passed on, depends on what you're actually dealing with. If the OC still owns it, they might try 2 or 3 CAs before they decide to take other action. If the OC has sold it, it might be passed from JDB to JDB...and each might have a different CA working for them. (The good news is that once a JDB gets it, the chances of them having suffienct validation is slim...and it gets slimmer each time its resold).
