divemedic
The FCRA requires that all tradelines have to be "complete and accurate." If the same account is being reported more than once (either twice on the same report, or on two different reports) with information that is not identical, then that information is obviously not "complete and accurate," is it?The problem here is that most of the FCRA has no right of private action. That means that the law does not allow private citizens to sue for violations. There is one section that DOES allow private action for inaccuracies. That is 1681s-2(. What that section say is that if you dispute inaccurate information, the furnisher of that information is required to investigate that information to ensure it is complete and accurate. If they fail to conduct this investigation, a private cause of action accrues. That is how you beat them. You dispute the tradeline, and if they verify contradictory information, they have just violated 1681s-2(. That is what we here call an s2b violation. You can sue for that. Before you do, though- make sure you know the ins and outs- read and study. Read and study.
