Collection Terminator
This collection agency sent me a collection letter 2 years ago (the very first one from them), for an SOL expired deb. I immediately mailed them a timely FDCPA dispute letter via certified mail. They ignored it. Now two years to the day, they have sent the same letter. I've just sent them another certified mail disputer letter, but is there anything I can do against these guys in court? Is this an FDCPA violation? divemedic
Yes, if you can prove that you mailed the first one. However, one lone violation will probably be defensible through bona fide error.
