motion for discovery

Hi everyone Im a newbe

Just a quick question. I filed a motion for discovery at the couthouse. Now who else should recieve A copy of the letter? I sent ont to ARROW but not thier lawyer. The reason I am asking is that on my summons they list the card# they purschased for considerable amount and it is not ours. I still have our old charge cards and the last 4 numbers do not match. I also thought they would scramble but we still have 1 #3 in our whole account. Iv also stated a counterclaim against them from info on this sight.

I'm also in a case with Arrow, how did you file the motion of discovery? What verbiage did you use. I was told to send a copy to Arrow by cert. mail, and to keep a copy for yourself, the orig. with courthouse. I'm thinking it wouldn't be a bad idea to send it to the attorney as well, my lawyer did say send to Arrow however. I'll let someone else answer. They are suing me for a Best Buy card.

Mine is also an ond best buy card. Iv noticed best buy list the card as closed on our credit report and the card should be listed as closed under the open date which was in 1997. We opened it in 93 and it closed in 1997 not 2002.

I just wrote a simple form letter listing the reason I want the info(the card #)

and asked for all doc. listing, payment history, card# etc and any form of documents that are to be used in court against me. I really never could find a sample to copy.

The plot thickens... Did they attach any evidence to yours? Nothing was attached to mine, which is why after being reviewed by a NACA lawyer she stated they rarely have the evidence that you owe the debt, their main goal is to get you to admit to the debt. When is you case? Mine is the 12th. I want to file discovery, which is what the lawyer suggested, I'm just at a loss on the correct wording.

Well did best buy have an end of the year sell?:p :p anyway you have a lawyer.Than your way ahead of me I feel like Im drowning and getting nervous. Our court date is the 15th of march. Iv called best buy but it has changed backers three different times since we had our card. No they had no doc. but an xxxx-xxxx-xxxx-3322 card number that they purchased for considerable amount. And are the listing themselves as assignee of best buy?

Theyve also reaged the debt on my credit report. So Im disputing CBs and the CA then the OC. Best Buy stated to me that the have no info on that account but I need something in writing. Arrow will not anwser any of my letters since I instructed them to keep all correspondence in letter form.

I was told that if Best Buy was to send you something in writing that they no longer have records on that account, it's pretty much a slam dunk for getting the case dismissed. They are listing themselves as the "assignee" on my summons. They don't even have an account # listed on mine! LOL It's so sad. Basically they are throwing around all the amounts and interested w/ attorney fees, that ironically totals to a few cents less than the maximum amount they can charge in small claims court. If you are sending all your correspondence via certified mail, I would bring that to court to let them know they are ignoring your requests.
