Can collection agencies legally call people at random

One company had already been in contact with a surviving spouse and were told there was no estate and no money to pay off the deceased's debt. In attempting to collect the debt began calling other people with the same last name and others with different names to "try to contact a friend or relative who may be handling the affairs of V____ _____".

If they have already been in contact with a surviving spouse and were told there was no estate and no money to pay off the deceased's debt, is it legal for them to randomly call people like that?

That's disgusting. Although from a business standpoint I can understand that they want their money regardless, that is STILL extremely disgusting.

Everyone's "estate" goes through probate court so they should wait it out until then. Is this a community property state?? If so, they may be going after the deceased's spouse.

NO.

1) I would send the CA a copy of the certified Death Certificate.

2) If it is for a debt that is covered by insurance, send the CA a copy of the Insurance Card or Proof of Insurance at the time the medical services were performed and explain the benefits.

3) If you're unable to pay, provide proof of your inability to pay such as documentation of Unemployment Compensation, or Disability Benefits, or the amount of Social Security Income. That way the CA would not waste time and money suing because they know they will not see a dime !!!
