What now?

Recommended Posts

On Tuesday I was contacted by Alliance One. I asked for their mailing info etc. I told the guy I could not talk to him as I was at work. After work I called him because he had left messages on both my phones that it was imparative that I speak with him. I tried in that conversation to ask him not to call me at work, however, I could not finish the sentence as I was barraged with a litany of dialog which included the statement "You will not call me on my phone and tell me terms you owe this money and how are you going to pay it?" In which I tried to ask him questions....let me put it to you this way.....I had stomach problems for the next 5 hours. I did file a DV and sent copies to the big 3 CBs that day (registered mail of course) and the next day I recieved a call from his "branch manager" telling me that I had been branded as not going to pay. I was told there was only 2 answers with this agency and it was claiming fraud or not willing to pay. I was then told that if I did not deal with them that Chase would put a legal demand on me (so what the hell is that?) and I did get him to admit that he was a collections agency. After reading what you had posted I am thinking there are some violations here?

Am I correct?

What woiuld be my next step in filing suit if I did have a case?

It is good to know that I am in a correct situation. They called again today but did not answer the phone when I answered it. Am I correct in just hanging up on them since I sent the DV and C&D?

I am also under a doctors care for severe depression (the CC company was aware of this because it is how I got into debt to begin with) so these guys are really upsetting to me and have made me a nervous wreck.

OK they are supposed to contact me within 5 days and did not. I also found that the company they work for is out of Pennsylvania and the DV and C&D was sent to the address in St Paul MN that the collector contacting me gave me. Question one since they did not contact me within the 5 days is there a violation? Question two should I send a copy of the DV to the main office in PA?
