Hello. first time posting and I need some help. I was using a company called Credit Solutions, I realized what was going on and pulled my accoutn from them. But too late for Bank of America - both my accounts went to their lawyers. Talked to one and they were so nasty - they bullied me into accepting theri terms of 500 down and then 433 an month. Then demanded i give them my checking oinfo or they would continue with and put a judgement against me. The verbal agreement goes into effect the end of month. I really can't pay this. They are insane. They told me not to pay rent for a month so I can pay them. HUH? Anyway, I don't knwo where to go or who to turn to. I have not slept in a few days over this. I have no family and i am alone on this one. Any suggestions, please?

Well...at any rate...welcome aboard...we've all been there, and know what you're going through. We'll help if we can.

First...get yourself something to drink...and read until you're eyes are blurry. There's all kinds of information here to get you started.

Here's a couple of thoughts to begin with. The "lawyers" are probably just another collection agency. DO NOT give them access to your bank accounts. Unless there is something in writing with your signature on it, the agreement didn't happen. Ignore them until you have a plan for how to deal with all this. Obviously, not paying your rent is NOT a good idea.

Is it just the one account, or are there others you haven't been able to pay?

Hey everyone.. thank you! You have no idea how your replies have helped me today. I started with Credit Solutions in Jan and they have taken close to 1400 for doing nothing. When I called them recently and they told me what they were REALLY doing - not what the sales folk had told me - I freaked. Then I got a call from Zwicker & Associates on bealf of Bank of America. At first I was told I was speaking with a paralegal working on my file. Eventually I spoke with a supervisor and she bullied me, telling me if I didn't pay by their terms there would be no other offers and they would aggressively take me to court. i was so upset I caved in to their demands on the phone. The other account that went to a separate law office was another BofA account I had. I called BofA and they connected me to them. They demanded 10% down or else we where going into arbitration. i told that guy i had not money. In the meantime, I called ALL my creditors and they are all working with me. I am only 2 months behind on most accounts - and have never had a late payment in 7 years! So they are willing to work with me. But NOT BofA. I will cancel my checking account first thing Monday morning. I will then send them a letter stating for them to leave me alone. at that time to I make an offer of what i can pay, and enclose a money order? If so, how will I know the money has been acccepted? I have never been in a situation like this before... so, thanks for the shoulders to lean on.

NO...do not send money. If you've got money to work with, you can send BofA a letter offering what you can (they probably won't except, but its worth a try), but do not send money until you have something in writing from them agreeing to accept our offer.

Thanks for all your help - I called BofA direct but they sent both my account to their legal for collections. I then got a letter from their legal stating terms of the conversation we had - I didn't agree to any of this, let alone talk to them about it - so sending them a letter with what I can pay. Also asked Credit Solutions for a refund. They will only refund one month ($681) but in order to get the money I have to sign a waiver stating they did nothing wrong and that I can not sue them... what a bunch of creeps! Again I thank you for your help and stuggestions. I've never had to face anything like this before.

You're moving in the right direction...

And, just so you'll know...BofA "legal" is probably just another department in the beauracy there...there might be someone with a law degree in charge, but chance are the people you talked with were just clerks. You shouldn't feel like someone with knowledge of the law is telling you what you agreed to do. Send them a letter...

As far as Credit Solutions...the fact they want you to sign a waive is indicative that they have probably been sued for their actions before. If you want to be hard nosed about this, you might tell them something like "...well, gee, if you won't give me my money back, maybe I should talk to my lawyer about this...".

Is it CreditSolutions.com? If so, fight to get your money back. Turn them into the BBB and I bet they will refund your money. Don't let them try to talk you into 50% refund, you need to demand your full refund.

This very same thing happen to me. I was summons in one month on two accounts after signing up with them.

If you need more help with this let me know!

Worried

Yes, CreditSolutions.com - what a bunch of scammers! I have reported them to the BBB, as well as, the FTC in Texas. As far as a refund, I demanded one and fought for it. At first they refused and I had to call 4 times to get to someone. Againk they didn't want to give me ANYTHING - that is until I asked them for the CEO's info and who handles their legal and public relationsion. When that person said: "Why? So you think you can sue us?" I simply stated, "No, not at all. A friend of mine is a producer over at 20/20 and he was asking for the info cause he tought it would be a GREAT story." It got me $681.00 back AFTER I had to sign a waiver. I need the money NOW so I signed it. If I ever have to go to court you can make sure that will be shown.

On a brighter note - if there is one - I managed to get BofA to agree to MY terms. They had sent a letter stating: "Per our conversation here are the terms we agreed upon" - Well, I NEVER agreed to ANYTHING. They were trying to strong arm me. I told them I would have my attorney contact them. Yes, I talked with thim - the snide person said; "Oh, YOU have the money to pay for a lawyer? We can drag this out and it will cost you a lot." Answer: "Who said anything about paying for a lawyer, not when they're family and want to see me win." They got quite and settled for the monthly amount I told them I can pay. They also sent me a letter stating this new agreement and that the other was in error. Let's see if they follow what THEY wrote!

Again thanks for all your support and help. If anything else develops - and I hope it does not - I wil let you know.
