I sent a letter (from the site) to an OC on a lot of late payments AFTER I disputed the info on all thee CR's twice. This is the second letter I sent them, and the first of anything I've gotten back trying to provide 'proof' that I was late.

Account is PIF. Furniture store. They sent me a copy of my agreement I signed. That is it. Pretty sure that doesn't constitute proving late payments, but you tell me. I asked for proof of the lates, they sent me a copy of the sales contract. That's it.

I guess my next step is an ITS letter stating you can't prove the late payments I'm sueing?

Validating that the payments were late by some sort of paper trail. Call if verifying/validating whatever. I'm pretty sure I made my point on what I was asking.

In layman's terms (since some might now get what I'm attempting to convey): is this proof of the late payments? I'm going to GUESS no, but I'm not 100% on if I'm right or not and don't want to screw myself over.

I'm not sure what you mean by "validation" because you can't DV an OC.

However, you can SUE an OC reporting false information, if you first dispute the tradeline with the CRAs.

So, really, all you need to know is, if I go before a judge - do I have the documentation to prove my side? Does the OC have the documentation to prove theirs? Is this beyond the SOL for collecting on the debt?

The disputing, the letter writing, the demand for payment history, etc, is all just a prelude to suing, if you get that far.

I didn't DV them. I sent them a letter from this site addressed to OC's asking them to verify the debt. I followed the instructions for it.

This is what they came back with. I know they can't prove the lateness, but I can't prove I was on time, either.

The debt is PAID. It's not a matter of paying them or getting them to leave me alone, it's getting that negative TL off my report.

If the account is paid, you could:

1. Try a goodwill letter.

2. Try a nutcase letter.

3. Sue and see if they back down.

They have no reason to keep the tradline on your file except out of spite or laziness. I'd try number one, then number three. A lawsuit is expensive to defend, especially when they don't have any money still due them. Others may have another opinion.

Goodwill isn't going to work with these people. I've been dealing with them for far too long. They have more than once called me at work previously (can't prove that; I NEVER gave them my work number) harassing me over paying this when I thought my mother was keeping it up to date since she needed the furniture and I took out the loan for her.

I'm saying that, just LIKE a CA, they can not prove I was ever late on the account. It's killing my credit. From reading the letter (link at the top of this pafe: Dispute with your OC's) I've got rights to sue under FCRA if they can not prove I was ever late on this account. I'm HOPING that I'm reading it right, but need a second opinion on it.

You can pretty much sue over anything. If you've got proof you were never late, and they are reporting you were and will not remove the lates, and you can show that their reporting is hurting your ability to get other credit, you can sue.

Will you win? uhhhh...since we've got the best legal system money can buy, who's got the most expensive lawyers?

I can get some checks where it shows that my mother paid on time (my debt, trying to help her out...) but other times (when she didn't pay) I covered in cash. I do not have those receipts.

SO, I probably have more proof than they do. I'm CC my ITS letter to the chairman of the store.

ITS letters go out today at 5PM to not only the idiot I'm dealing with, but to the chairman and the president/CEO of the company.

Also submitted a complaint to the Texas AG. These people are worse than the one CA I've ever had to deal with. I'd love to see what sort of evidence they'd bring to court. Talk about bookkeeping nightmares within the store.
