CantCU Posted March 13, 2007 Report Share Posted March 13, 2007 New here, but I need your help! I have been using TrueCredit for a few months now trying to make sure that I keep on top of my credit. A few days ago, I received an email stating that there was a "major derrogatory" on my Experian credit report. I immediately pulled the report, and found these scumbags had done an IQ on from Experian on 2/16/07 and as of 3/7/07, they reported a collection account, using the date of 9/2006 as the date opened. I had never heard of these people...so I immediately drafted a DV letter to them. Problem is, the address on the Experian report is NOT the address that I found on their website. SO, I sent the letter to the address on the credit report, but I then faxed a copy of the letter to the fax # on their website.On 3/10/07, I received a letter from them postmarked 3/7/07, offering to settle this case. The address on the settlement letter is still a different address (it's a P. O. Box #) than the address on the website and the address on the CR. Do I need to resend the DV letter to the P. O. Box address as well? I have sent the first letter certified/return receipt, but it has not had time to arrive yet and be signed for. I'm not even sure if they will receive it since it was in NYC and I am now finding new addresses for them that are not the same as the one on the CR! There was no phone # listed on the CR in which to contact them. So I have had to do my research even to find out this information.Their offer to settle is about 1/3 of what they say I owe, but I don't owe them anything. I am sure that a lot of this information is already posted on this great website, but I have been reading for over 2 hours and still have not found everything I need...so here goes. I got angry and started filling out a FTC complaint, but did not send it, deciding to give them time to get the letter first that I mailed/faxed. I did the same with the BBB...deleting it before I submitted it. Decided instead that I would write a dispute letter to Experian. Problem is...where in the heck would I mail this letter? I've printed their report, and their address is not on it. I've searched their site (and others) trying to find a mailing address to write them. The information I want to say is too lengthy for their online dispute form, and I have never had any success in filling out those forms, anyway. Every site I visit tells me that I have to go to their website to dispute the entry. Well, I don't WANT TO. I want to send them a certified letter with attachments, proving what I am saying, but there is no way to attach proof to an online dispute.So am I heading in the right direction here? It's fantastic that you've jumped on this right away,but take a breath and CHOOSE your battles. You're well within DV time requirements so keep reading and don't freak out. CA's love freaked out consumers especially if they have cash (I've starred in that movie).Freaked out consumers tend to give out too much info to the CA's. I think all the the CIC allstars are watching TIVO'd American Idol,but they'll slink back in and help you out. They always do. Get some sleep. You are ok.Even if you didn't get your green card back yet, you can find out if it has been delivered by entering the tracking number on USPS.com. CantCU Posted March 13, 2007 Author Report Share Posted March 13, 2007 Update...a notice was left but they have yet to sign for the certified letter. This is a old debt, 2004, involving my bank. I had 2 accounts with them, mix up on a deposit was made; I took care of it and they agreed to waive the fees for the overdraft. Never heard another word until now. The bank has never reported any negative activity on my credit report, period, even though I had had a loan with them a few years ago and that positive payment is there.Will keep watching for more information so I can keep pushing this. I already have my letter drafted to CRA...I just need to know where to mail it.Now, with that said, has anyone ever used the USPS certified/return receipt online? It's difficult for me to get to the post office to send certified letters but if that is what I need to do, I will.Thanks again for all the help. I received something from them, and after some digging found out his new name is Plaza Assciates.Found numerous bar complaints and even 2 Federal class action lawsuits. I also disputed to the CRA. 3 days after I faxed my DV letter to Plaza, they reported to the other CRA's (had only been reported to one at the time of the fax). Don't you just love TC's alerts? I've even printed them off to prove they reported after they were on notice! (still waiting for the CMRRR, though). They'd better back off...I'm not a big lawsuit type person but this just makes me furious. I just love the internet, though, because I can get all the forms I need to file in small claims court right online, and not even have to go to the courthouse!Joan Link to comment Share on other sites More sharing options...

But this firm routinely violated the FDCPA since they kept reporting invalidated debts. Since you have 1 violation go ahead and file your lawsuit now. Since you have 1 violation go ahead and file your lawsuit now.Wouldn't this count as 2 violations since they made 2 reports (one to TU and one to EQ) but who's counting?? I need my return receipt (which is actually signed for but not back in my posession) showing they signed for the CMRRR before reporting to the other 2 bureaus as well. I also knew about the class action suits and bar complaints. But as soon as I mention the CA Bar, I knew I would not be hearing from them again.
