nini Posted March 14, 2007 Report Share Posted March 14, 2007 I have 2 CA. 1 is Asset Acceptance LLC for $440 and the other is Arrow Financial Service,(don't even know what thats for) Anyways I want to DV both of these but I am scared what if they want to sue me? Has anyone had DV'd them? How did it turn out? The SOL in OK is 5 yrs I think the Asset one should be coming off anytime, it only has a date of status which is 07/2002and date opened on 04/2004, i am confuesed I dont know what date to look at. I made the stupid mistake to let a friend get phone service in my name and she left me with a $400 bill. The date you need to know is the "date of first delinquency "DOFD" not the date of last activity. You should have some idea of these dates to determine the statue of limitations. Did you get letters from both of these agencies? If you did, it's important to DV within the first 30 days. I know you say you don't want to wake the "volcano" however, they can put this information on your credit report. Many times they do and this is how many people find out there's a problem. It may not even be your account! The SOL for Oklahoma is 5 yrs. for written contracts and promissory notes; 3 yrs. for oral contracts and open ended accounts. Remember that the DOLA, date of last activity is not the same as DOFD, date of first delinquency. You are concerned with the DOFD. For example, if the last payment you made was in 2/2001, then you could count 180 days from that to determine your DOFD.
