pulpfiction Posted March 14, 2007 Report Posted March 14, 2007 NCO left a message on my voicemail at work 6 months ago. Called them when I get home (with my recorder running, of course....) The phone-monkey that takes my call informs me that I'm speaking to "NCO attorney network" He informs me that there is a "pre-judgement" that has been filed against me. He then tells me that he is "sending the account for suit" It's been 6 months..no lawsuit was filed. No mini-miranda, eitherThis account has been passed around to another jdb. To sue, or not to sue?
Recovering Attorney Posted March 14, 2007 Report Posted March 14, 2007 You could. Generally those cases aren't worth much. If NCO is licensed to do business in your state, sue them in a lower court
IHateCAs Posted March 14, 2007 Report Posted March 14, 2007 Since it's NCO, you can talk to their counsel directly and get a settlement. Can't remember the name of the lawfirm, but it's in Louisiana. Go to NCO's page and they'll probably have the name and contact info for their general counsel. They'll want a copy of the conversation of course.I'll leave it to you to determine which statutes they violated.
pulpfiction Posted March 14, 2007 Author Report Posted March 14, 2007 One step ahead of you, IHateCA's.. NCO farms its compliance work out to Sessions, Fishman & Nathan in Metaire. Specifically, Michelle Lyon:http://www.sessions-law.com/MichelleALyon.htm

gtty Posted March 14, 2007 Report Posted March 14, 2007 Find a lawyer to take this on contigency. They cannot tell you they are filing suit, and then not do it. I believe the case is worth $1000 to you plus attorney fees. My 2 cents......
