GoldenGrahams
An attorney has entered a judgment against me and had my banking account frozen. I see have been doing research and think that the statute of limitations for NY have been met. Can they still enforce their judgement
LadynRed
The time to argue SOL was BEFORE you were sued. Once the debt has been reduced to judgment, the SOL on the debt is meaningless. The new SOL is the judgment itself - 20 years in NY. They can try to enforce that judgment for the next 20 years - and your account will NOT be released until you pay them or make some arrangments to pay. IN addition, they will levy your bank account for TWICE the amount of the judgment - so be prepared for some whopping overdraft charges from your bank. GoldenGrahams
I understand that since I receive SSI that they are not entitle to take the money from my account. If this is true then can I still be held responsible for any fee that my account incurs? The time to argue SOL was BEFORE you were sued. Recovering Attorney
Your bank is going to charge you no matter what, unless you make a big enough stink.
