mattandallismom Posted March 14, 2007 Report Posted March 14, 2007 This is my very first post and I'm so excited I found this board! My husband and I are cleaning up our credit reports because we plan on refinancing our mortgage this summer. I pulled my free credit report today and saw 3 medical bills that weren't mine. I put them into dipute with the credit bureau and contacted the company that claimed I owed. BIG MISTAKE! The woman I spoke with said she couldn't find my information and would need to call me back. She called me and said that I wasn't responsible for the 79.00 medical bill because it wasn't mine but she crossed referenced it to an old debt for breaking a lease from 2001. It's for 3300.00 and if I don't pay it in 30 days she will report it to the credit bureau. She said she will send me verification of the debt in the mail. She claimed that in 2001 when I lived with this person she "crossed referenced" to me that a claim was filed against us for breaking our lease. We did live together and moved out before the lease was up but the manager of the property said he could get it rented quickly and didn't indicate we would owe. When I asked her why I was never notified of owing a debt she said that the statements that were mailed to the address we vacated were returned back to her. ummm yeah... could be because I moved. I never received any notice I owed this debt and no attempt was ever made to contact me. What are my rights here? It smells a little fishy to me. Thanks in advance!
rm2738 Posted March 14, 2007 Report Posted March 14, 2007 The good News is that they can not list on your CR until they notify you in writing I believe. The bad news is that it sounds like you had a verbal agreement between you and the manager and that will more than likely not hold up. If it was from 2001, wouldn't the SOL almost be up? Depeneds what state you're in, but it's usually 7 years.
