bridgett68
I sent out DV letters. Two have come back without infomation that i asked for such as copies of statements, anything with my signature, etc. The only info recieved was name of the OC acct #, balance, and my personal info, on their company letterhead. From what i have been reading on this site this isnt proper validation.....RIGHT ?? Can someone please tell my next step ?? Also when are they in violation when the letter states "this is an attempt to collect a debt" ??
SecretAgentWoman
February 23, 2007Dirtbag CollectorsPO Box 666Anywhere, USA 00000Re: Acct # XXXXXXXXXXXXTo Whom It May Concern: On February XX, 2007, I sent you a request to validate my debt under the Fair Debt Collection Practices Act and all I received was an “account statement” of the alleged charges you claim I owe you. This is nothing but hearsay, and does not meet the Federal Trade Commissions guidelines of what constitutes proper debt validation. Your “account statement” on your company’s letterhead proves nothing. You have not shown me a statement from the original creditor, any payment history, or any accounting of all of how you came up with the amount you claim I owe. For all I know, you made up numbers and reported them. I notice that you are still reporting this collection on my credit report, which is considered to be a collection activity. You are now in violation of the FCPDA, and are now subject to fines of $1000, plus actual damages and attorney’s fees, which I may collect from you by filing a claim in small claims court. I expect you to immediately to answer to the validation request that you still have not satisfied.GIVE THIS LETTER THE IMMEDIATE ATTENTION IT DESERVES. I expect to hear back from you within 15 days. Sincerely,MeWorth a shot.

sjokinley
Hey SecretAgent Woman, great letter! You know, I hadn't even realized the few "validations" I'd gotten back were just printed statements on the CA's letterhead until I read this thread. Thanks guys. skybluepink
I send a DV letter to a CA and got a package back with photocopies of statements from the OC (looked like copies of the statements) only thing is, one has a payment (I don't even think its correct). That was it!I'm going to send them a letter saying this isn't enough to validate the debt. Any suggestions? And it is within SOL.
