Debt with Original Creditor, not past SOL

I have a question about Capital One who is the OC.

The DOFD is 06/2005 so it is not past the SOL for VA.

It was CO on 12/2005 @ $600.00

My question is: Should I DV the OC here? I'm a little worried because the SOL hasn't past on this debt. Even though it was CO in 12/2005, the balance is now up to $808.00. If I wait until the SOL is up, it could well put me over $1000. Every month is it updated with a new balance.

The status reads: Account charged off/Past due 150 days. $794 Written off.

$808 past due as of March 2007.

Any thoughts as to how I can go about this?

Yep...fraid so. Charge off is just an accounting term. Doesn't mean squat to us. You still owe...they can still try to collect...they can still charge interest up until the TL says "sold to another lender" or until they issue you a 1099c for the "found income". (And, even if you get the 1099c, there still might be a JDB coming at you for the account).

Oh, we never DV within the SOL period. Too risky!!!

It is well over a $1000 now; $794 (written off) + $808 (past due) = $1602 (I think?)
