Hi Everyone !! I first want to thank you all for this wonderful site! I've been a lurker for quite some time now and have managed to delete 7 items from my DH credit report and 4 from mine. I still have much work ahead but its still quite an accomplishment. My question is I have a collection on my CR from Merchants & Medical listed on my CR twice I disputed and it came back "verified" (of course). I then sent a DL letter and in return they sent me out 2 copied papers with the hopsital name at the top of the paper listing my name, date of service, and what the charges were for. They made it look like it was the hospitals printout to them and there were some numbers scribbled at the top. My question is my name on that so called bill is incorrect because its showing my married name and at the time of service I was engaged using my maiden name still. Do I send another letter to them telling them this or what?

If I understand correctly you are saying that a real document from the hospital would have your name listed using your maiden name, not your current name. You are trying to say that the CA made up this document as if the hospital had supplied them with any info it would be in your maiden name, is that correct? It wouldn't be unheard of for them to try that.

If that is the case don't tell them. Is this bill something that is yours and do you owe it? Has it passed SOL in your state? Did you have insurance and do you have the EOB if insurance did pay any portion? Lots of questions I know but a little more info could be helpful.

Yes Dpgirl that is exactly what happened. This medical bill is mine and at the time I had no insurance. The SOL is not up yet. I'm not really sure what to do next about this considering it is MY debt.

No...actually...the documentation they sent you was clearly NOT your debt. They obviously fabricated something. Maybe you do/did owe the hospital something, but these people do not have the right to collect that.

If you have money to work with, I'd suggest you call the hospital and see what can be worked out.

If the bill is too large for you to handle, you might first think about the fact that the CA has committed fraud...and, I'm pretty sure the OC can be held liable for the acts of their CA's. However, I'm guessing you'd need a lawyer to sort that out for you...

I wish I could afford to settle even though its not much at all total of $1400. Economy in Michigan isn't going to well. I want Merchant & Medical to know that I know what theyve done but I'm afraid to take it any further. Do you think there's a letter that I can write as a scare tactic perhaps an ITS? Maybe they will back down. Hopefully

You probably could take them to court and even make some money off this. What they've done is not only a violation of the FDCPA, but, I would bet there are some criminal counts against them.

If you're so inclined, look into actually suing them. You could probably find an ITS on the board here somewhere...but just threatening them isn't going to make the underlying debt go away. You'd almost certainly have to follow through...

Is it possible that the CA didnt change my name on this printout and that the printout they sent me is the hospitals and that the hospital switched my lastname. I had a total of 2 bills. One was under my married name (years later). Sorry Im asking again but Im just trying to figure out what type of letter to send out to them next because to them thats proper validation.

Okay, then it is possible that when you were in the hospital with your married name, they went into their database and changed their record to show your new name...then, when they printed out the charges for the collection agency, they have your married name on it.

So...this could be legitimate. (Forget what I said about suing them).

Sounds like they've given you sufficient validation.
