Asset Violations?

Help, at a loss and have no idea how to proceed. I pulled my credit reports in Feb. and found that Asset has picked up from GA Financial who bought the acct from Providian. I did a few settlements back in 2001, but moved to Ohio from PA in 2002 and can't locate all the documents.

I sent a certified C&D letter to Asset, also requesting validation because I never recieved anything from them in the mail prior. This letter was picked up at the post office on 3/6/06.

I got a letter today in the mail from Asset, thanking me for my request for furthur validation, which provided me no information. However they also prepared a settlement offer and enclosed it.

Do I send them another letter stating that they have failed to supply the requested documents, before starting to collect again, btw sol on open end accts is 6 years in OHIO and PA. & the last date of activity was 08/22/00, so they are screwed there I think.

Additionally I disputed with the big three and Experian verified and updated info last week, and shows late on CR.

What do I do now? Wait till the 30 days expired on orgianal request and send another letter, or go to court house and sue because they are reporting and trying to collect on an expired acct.

Ouch...courts in ohio have held that the SOL on CC debt is 15 years. Do some searching on the board here...

Absolutely. You should also be prepared to attack this on "chain of custody" grounds for resold debts.

sol on open end accts is 6 years in OHIO and PA.
PA maybe, but not ohio, I think.

What do I do now?

Two choices, I guess...send off the DV pointing out they screwed up, or wait to see what they do next. I don't think you really have enough to sue with at this point.

According to this website and TILA all credit cards are consdered open end, is this true or am I misunderstanding? Additionally, I have disputed and they are still reporting in collections. I have busted my a$$ to take my credit score from mid 500's to over 700 only to have these fools take it back from me by buying old debt that I feel is past SOL.

yeah here in ohio our laws are so slcack when it comes to consumer credit. Im wondering if the whole state of Ohio is owned by JDB.8-)

Yeah it is 15 years for a cc here in ohio.

And the laws are ambiguous as hell. i think im about to lead the charge here and get some backing to have some of our laws changed regarding consumer debt reporting. Here in Ohio a company doesnt have to be licensed or bonded to collect debt. These practices has to stop.

I've been wondering what it would take to do this myself. Our laws here are horrible.

I'm in the middle of dealing with ASSet right now. Re-aged an account. Bud Hibbs referred me to this set of lawyers at myfaircredit.com
