North Carolina is another state that doesn't seem worthwhile to collect debts in. Tough state anti-collector laws, no garnishments and short SOLs.

which is one of the many reasons I love it here.. that and the ocean, the mountains.. the people.. there is a reason I call it home (being the #1 seed in the NCAA doesnt hurt either :)

However don't kid yourself.. Unifund seems to think we are like fish in a barrel here they file lawsuits as often as I change my lip gloss...

Yet, they are still trying to collect on an account that they say I have w/ them. Also, they are trying to collect on a time barred debt which is a no no in NC.

"§ 58‑70‑115. Unconscionable means.

No collection agency shall collect or attempt to collect any debt by use of any unconscionable means. Such means include, but are not limited to, the following:

(1) Seeking or obtaining any written statement or acknowledgment in any form containing an affirmation of any debt by a consumer who has been declared bankrupt, an acknowledgment of any debt barred by the statute of limitations, or a waiver of any legal rights of the debtor without disclosing the nature and consequences of such affirmation or waiver and the fact that the consumer is not legally obligated to make such affirmation or waiver;"

I disputed account w/ the CRAs and they(Portfolio Rec.) sent me a letter asking me to provide them with the info. they need to verify the debt. They have since verified w/ all 3 CRAs. They also included the "miranda" in the letter. Isn't that viewed as "continued collection activity"? How should I handle this one? This account is 2 years past SOL in NC. Any advice is appreciated.

Called a certain JDB who has an old SOL debt still sitting on my report.

I asked for info on the account. CSR was very nice, but said she couldn't send me any info. She transferred me to supervisor. Supervisor had a stick up her behind. I asked her to at least send me a collection (dunning) letter showing the amount they were looking for. She said she couldn't. I asked why and she stated again that she could not do that. I asked again (very calmly and friendly...on purpose). She hung up on me.

I called back; got a different CSA. Told her I can't find the letters they've sent me, could she please generate another. She said she would have a letter sent out. I thanked her nicely.

Now, what in the world should I do if a JDB with an inactive license sends me a dunning letter for an SOL debt? :twisted:

I got a letter from them today so I CALLED the NCDOI and found out they may not be inactive after all.. she said they had a system wide problem that accidently left several agencies Inactive that may not be. It happened on March 9 and they are trying to correct it. They said it should up to date in a few days :(

Just for fun I checked out the DOI to see if it had changed.. the girl on the phone insisted it was a glitch on the 9th and it would take a few days to correct (which already seemed odd since I called them on the 20th..

.. but it seems to me it would be updated by now.. Portfolio is still showing inactive as of today....

oh this dunning letter is looking better and better.. lol

Portfolio Recovery permit #4132 is NOT active in NC.

I received a response from NCDOI this morning, and while my contact there could not verify why the license is no longer active, he did state that word is beginning to circulate around the industry that violating North Carolina statutes could have some "profound consequences."

North Carolina is another state that doesn't seem worthwhile to collect debts in. Tough state anti-collector laws, no garnishments and short SOLs.

I'm surprised it's taking this long. I know some JDBs that cherry pick states and avoid states like Texas and NC.

Hi guys...a couple questions from afellow north carolinian...

How did you guys check to see if the collector had a license?

Does it matter if they have a license?

In what other ways does being NC help us fighting against CAs? Someone had said it was hard for collectors in NC. how so?
