How do you settle with JDBs?

Ok, I'm going to come clean and just say right out there that improving my FICO score is not on my list of priorities right now...my main goal for credit repair is to be debt free...however, I do want to negotiate PFDs where I can.

So the question that has been bugging me is how does one go about settling with a JDB? I mean, I want to make sure that they are the legitimate owners of the debt that I owe, so this nonsense DV like the one I got from Resurgent Capital isn't going to cut it with me....but how do you go about getting through to these nitwits that "Yes, I want to pay what I owe, but give me credible proof that I owe it to you!".....do you just wait until they take you to court, and hope that the judge will force their hand?

Sorry if this is rambling, but it's been on my mind lately....

Thanks! I always like Dive's stuff.....he makes a lot of sense....

I guess to me, my biggest fear is being sued by a JDB....I do have some things in my favor - wage garnishment is not allowed for consumer debt judgements in SC (I don't work outside the home, but my DH does, and has some outstanding debts that are with JDBs), and most of the debts that are in collections are less than $1k....and SC has some good exemptions when it comes to things that cannot be seized....

I guess I just have to take the stand and say "Look, here's the deal, you will get your money when you show me that I owe it to you, you must delete it from my credit reports....and if you sue me, your judgement will be a worthless piece of paper...."

Why would anyone settle with a JDB? In all likelihood, they paid two cents on the dollar for your account--and, therefore, have zero documentation. DV them, dispute with the CRA's..and then sue if they don't go away.

If you ask me...JDB's are ridiculously easy to deal with. A junk debt buyer should be paying YOU, if you play your cards right.

Follow Admin's DV Flowchart.

If the CRAs give you any static or you don't feel are being responsive when you dispute with them, then take a look at MOV--but only if you're willing to sue the CRAs. Otherwise it's probably a waste of time.

Since SC is a one party state for the recording of phone calls, you might consider picking up a telephone recording device. If they call you, you can record 'em and catch 'em in violations.

Problem is, many of them have no proof; and they don't have enough $ invested in the account to take time to fabricate something.
