Received a letter from them about 1-2 weeks ago. Yesterday checked my credit and bam they nailed me on 3/12/07 for an Alltel account. I never had an alltel account. I applied once for one, but decided not to get it. I sent them a DV overnight. Contacted their AG. They are stating on my report that the account was opened in 12/2006. Wrong there are no inquiries on my credit report from alltel in the last 2 yrs. Also the great thing is I found a copy of my CR from 2005 and 2003 and guess what? NO ALLTEL nor any collection from them. My biggest concern is the fact that everyone keeps stating how hard it is to get them to remove from the CR. What legal action should I take and how long do I give them before seeking legal representation? If it is soon then does anyone know of any attorneys in western PA or northern WV? Thanks!! I am so pissed I can't freakin sleep!!! HELPPPPP!!!!!

Correct me if I'm wrong, but isn't Alltel the OC and not the CA? You DV CAs, not OCs.

With OCs, first you must dispute with the CRAs.

http://www.creditinfocenter.com/legal/FCRA.shtml#623 and scroll down to (8)(a) ABILITY OF CONSUMER TO DISPUTE INFORMATION DIRECTLY WITH FURNISHER

After disputing with the CRAs, if they verify then you'll want to dispute with the OC.

You may want to also pursue MOV with the CRAs. However, you only do this if you plan to sue the CRAs as well as the OC.

I would pursue MOV just because if the OC won't blink in the face of ITS letters, then the CRAs might.

No the post office tried to deliver on Sat, but were unsuccessful. The PO stated they will try again today, so we will see. I sent out my disputes with my current and past credit report, which no of them have an inquiry nor an alltell account. So this should go in my favor. Thanks.

I too have recently received a collection letter from AFNI for a phone bill over 4 years old. I didn't want to send a DV letter to a PO box because I wasn't sure if it could be signed for (it can as I found out from reading the postings and also from a postal worker at my p.o.), so I went to the BBB and found two different street addresses for the company. I sent out 2 DV letters CMRR to the two different street addresses on 3/8. I got one green card back signed and dated 3/13. I tracked the other and apparently it has come back to my original p.o. on 3/16. I haven't received anything yet from my p.o., but I figure they received one of the letters, so the ball is in their court. The address that I got the green card back from was:

AFNI, Inc.

404 Brock Dr.

Bloomington, IL 61702

The other address that I sent it to with no delivery was:

AFNI, Inc.

420 N. Main St.

Bloomington, IL 61702

Now I'm waiting for verification. I'll keep you posted, and maybe you'll have luck with the above address too.

I wouldn't Email 'em. I don't know of ANY legal restrictions on a CAs or OCs use of one's Email address, and Lawd only knows what sorts of shenanigans they'd pull. I suspect they'd sell your info to SPAMMERS. Worse, they could use your Email address to "google" you and try to find out where you bank, shop, work, etc.

My advice is don't do it.

Would you email the company?

Found on webpage:

Important Note Regarding Collection-Related Inquiries:

If you choose to communicate via email, please remember that no matter how many measures Afni takes to ensure the confidentiality of your email, the Internet may be a non-secure medium for communication. If you choose to communicate your collection-related inquiry via email, Afni cannot be responsible for any possible disclosure of an account to a third party.

For all the good it will do, which is probably nil.

It is a huge waste of time. I opened a complaint with the BBB against AFNI. The rep from AFNI responded twice that she couldn't find an account in their system for me. She kept requesting the AFNI account # again (which I provided in my original DV). Also, how could they keep verifying with the CRAs if they can't even find me in their records? The BBB was useless....basically just facilitated emails going back and forth. The only good thing is that I have further documentation against them for violations.

The account is still on my report, they have yet to verify and I am going to sue.

I've become quite obsessive/compulsive over these scumbag CA's. The way I see it, I can do an online dispute with the BBB...when they investigate, it takes the file off some CA's desk and makes them accountable for their actions. It may be pointless, but at least, it's time away from their job of harrassing people...making them stop and deal with the paperwork.

I too am fighting with AFNI ... here's my question. If I have a copy of my credit credit from 2005/2006 which does not show the deliquency, how can the this show up now for a debt in 2001?

Doesn't the debt have to be reported in a timely manner?

Well i have problem with AFNI as well. It seems even though Dishnetwork told them my account should never have gone to collection, I figured problem solved they will report to CRA's to delete. AFNI decided to do me a favor and update Credit Report as paid. Not sure how they could report like this even after Dish told them it was not mine and pulled account.
