bridgett68
I have DV the CA sent the 2nd DV with no response and its been 15 days. Anyone have a sample letter to send the CA insisting they remove the listing in 5 days (or else I will sue ). Ok so I put my own letter together. Re: Acct # 29523To Whom It May Concern:This letter is in response to failure to validate a debt. On February 00, 2007 I sent a letter requesting validation of a debt, which you failed to provide.Due to your offices failure to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately. I notice that you are still reporting this collection on my credit report, which is considered to be a collection activity. You are now in violation of the FCPDA, and are now subject to fines of $1000, plus actual damages and attorney’s fees, which I may collect from you by filing a claim in small claims court. Deletion of account #XXXXXXXXXXX on any reporting agencies it resides on, including but not limited to: Equifax, Experian, and Trans Union, shall take place within five (5) business days to all credit bureaus that you submit to.Please be advised because you are in violation of the FDCPA, section 809 (. a lawsuit will be filed if this collection listing is not immediately removed from my credit report.Sincerely, PLEASE give me any ideas..............................................
