My credit report shows this: 5/04 150+,4/04 150+,3/04 120, 2/04 90, 1/04 60,12/03 30... the SOL in AZ is 3 years for this as I believe it to be an open line as it was a hsbc/yamaha revolving credit card. If this judgement was granted in Jan 07 was that not past the SOL and if so what do I do about it? I am about to settle the $10k judgement for $6500 but if it is past the SOL should I not do that?? Also, is the SOL for the state I live in or the state the OC is in? And if it is/was past the SOL can I have the judgement vacated?Thanks! Link to comment Share on other sites More sharing options...
CarolinaBlueEyes Posted March 20, 2007 Report Share Posted March 20, 2007 the SOL is in the state in which you live.. it has nothing to do with the OC.. however it doest not matter when the judgement was rendered.. it matters when it was filed with the courts and in many cases that can be months before the actual judgement.. chances are they were on time since it was granted in Jan.IF you settle make sure to get EVERYTHING in writing in advance and DO NOT GIVE them any banking information.. pay it through certified funds or a different account Link to comment Share on other sites More sharing options...

momof5 Posted March 20, 2007 Report Share Posted March 20, 2007 Hawaiiguy.....According to the law, the OC can use either, however, practice shows that since to have personal jurisdiction over you, you have to be sued in the county in which you live.....the law of the state that you live in applies. Am I wrong?yes.. think about it if you were sued the judge would have to know every SOL in the US.. it covers the state you live in . .that is where they have to sue you. If I went to NY for the weekend and opened a Macy's card and shopped there .. I defaulted they would still sue me in NC and the SOL in my state would stand. Research to make sure that the OC had begun legal action on or before 11/2006. Admin says that if they did not follow the law, you may be able to have a Judgment vacated.For more information, Read this Article by Admin: "Do you have a Judgment against you?
