Capital One reports dispute for 6 days????

OK, I sent Cap 1 a DV letter for a collection they are suing me over. (The SOL expired about 4 months before they filed).

They signed for the letter on March 6. On March 14, it show'd up on my CR that I am disputing. Today, March 20, it shows a change back to what it was BEFORE disputing, as if it is no longer being disputed.

New CAPITAL ONE , xxxxxxxxxxx

02-2000 Bad Debt; placed for collection; skip $2,405 $2,405 03-2007 Charge off account , Account closed by credit grantor , Closed

Previous CAPITAL ONE , xxxxxxxxxxx

02-2000 Bad Debt; placed for collection; skip $2,405 $2,405 03-2007 Consumer disputes - reinvestigation in process , Closed

The only thing I have ever received from them since sending the DV letter, is a flyer offering a settlement for about $400 less than what they are suing me for.

I don't owe this money.

What are the guidelines for them reporting the dispute? Is there a minimum or max amount of time that it has to be shown on my CR?

If it's SOL, then use that as an affirmative defence when you file your answer.

Well, I have a feeling they will try to say the SOL has been tolled since the CRAs show the DOLP as 6 of 2002. This is not true and they can not have anything to show for this since I never made that payment. I just want to have as much ammo with me as necessary the next time we go back to court..(next month).

What's the tolling law for your state? I have a feeling they will need more than that, not to mention.. proof.

It's 6 years. The DOLA has been being reported as 7/2000. They filed in October 2006, which is almost 4 months after the DOLA. This was from my credit report dated 3/12/2007 that EQ mailed to me. On my latest report, they have changed the DOLA to n/a.
