PFD~What if they dont delete??

I am currently in the process of writing a unsolicited settlement offer on an old electric bill.

This bill went to collections in 2005 .....at which time I wouldn't say that I was niave...but more like just plain stupid. I came to a settlement with the collection agency Capitol Recovery Services they said they would accept $99.70 of the original balance of 299.70 as payment in full. This agreement was over the phone they had called me......yea I know like I said just plain stupid.

As per our discussion I would pay in 2 months so I sent 1st payment of 25.00 then the next month a payment of 74.70. This occurred in Feb and Mar of 2006.

Months go by I hear nothing so I thought it was over and done with ....BTW Capitol Recovery Services had never placed this account on my credit report neither had the OC.

Then in November I recieved a collection letter from a new agency Allied Interstate for the Balance of 200 on this old electric account. So I figured fine they went back on offer and sold the debt so I made a 20 payment and planned on paying the other 180 in a couple weeks. A couple days after they cashed my payment Allied plunked the account down on my credit report.

I called them once after this happened and offered to pay them if they would delete this info off my CR, they said no I said ok a paid collection is as bad as an unpaid collection and told them I would keep my money.....I then got cussed out I was told they didn't want my F***ing money...that threw me for a loop cause if they dont want the money why do they harrasse people????

So now I am writing a settlement offer I will happily pay the 180 that is owed if they will delete from all 3 bureaus. If they agree to do this in writing whats to say they will not turn around after they cash the money order and just not do what they said and leave it on the report........is there any recourse if they dont delete like they agree to???

Definately make sure anything you agree on is in writing before you send money..... and make sure the letter says something about the account being paid in full in addition to deleting to all three bureaus..... and when you get the letter if they dont delete... send a copy to all three bureaus.... I am sure that you will get more info from more experienced members about this

Once again I ask the rhetorical question:

Why in the world would you 'settle' and pay someone you don't owe money to?

Oh yes, If the PFD was not agreed to IN WRITING before the money sent, it never happened.

I understand now that it should have been in writing but that was over a year ago and was the very 1st time I had ever had to deal with a collection agency over the phone before I had always just paid my collections and went on about my life.......I really didn't have any idea what type people they are.

My main objective at this point is to get this off my report.......if they wont do that then the money stays in my pocket and I know of a butt they can kiss8-)

Well talked to someone at Allied Interstate again today. This time I had the recorder going. This guy didn't cuss at me but he did fail to inform me that it was an attempt to collect a debt and any information obtained would be used for that purpose.

After the call I was reading some more here and found info about talking with the OC so I decided to see if they still had the debt. Sure enough that electric company still has the debt and I told them I would never send payment thru Allied as they had violated my rights and the law and that I would only deal with them. I told them I wanted to take care of my debt but that I needed to protect my credit in doing so. They faxed me a signed agreement that they would remove all negative remarks concerning this account upon reciept of payment. So payment is being sent along with a copy of the agreement. So now Allied can kiss my A**
