I have thought about sending them a Debt validation letter, but I'm a little scared. When you send a Debt Validation letter does this change the "last date of activity"? My last date of activity for this was 10/2003. I know Texas has a SOL of 4 years, but I'm not sure if it has ran out yet. Can anyone give me some advise on what I should do? We kept previous tenants files for two years and then shredded them. The only way the company would have access to anything after that, would be if the tenant had been evicted and the police actually called to lock them out, then the police department might have records, but I doubt the OC would go that far to validate a debt.The above mentioned because you mentioned DV.As for the SOL being tolled, I believe in most states you either have to make a payment toward the debt, or in the very least, acknoweledge it in some form or fashion. Questioning a debt is a right and you shouldn't be punished for it. Make sure if you do DV them, there is in the letter somewhere that you do not believe this debt is yours, that you are not refusing to pay, you just want more information because you do not believe it is yours. soccerpal144 Posted March 21, 2007 Author Report Share Posted March 21, 2007 Thanks for the advise.....yeah we were never evicted.. We just up and moved out without giving a 60 days notice. So I'm not sure if they will have any record of it, but the CA that is trying to collect for them is National Credit Systems, Inc. They apparently collect for apartments. Have you ever heard of them?
