CA Initial Contact

When a CA is first assigned a debt and they send you the 1st collection letter I know that you have 30 days to dispute it and during that 30 days they have to stop collection efforts....my question is do they have to wait till the end of the 1st 30 days to report anything or can they report that debt to the bureaus just as soon as they are assigned it??

I beleive they can report it as soon as it is assigned without making contact with the consumer. Some may even report and never make contact by mail or phone.

However, if they do contact you and you respond within that 30 day window if they report without validating the debt, they would be in violation.

They may have reported it as soon as they were assigned the account for a CA, or as soon as they purchased the account for a JDB. But, if they are reporting they must note the TL as in dispute when they receive your DV.

If you DV within the first 30 days, they may continue collection activities as soon as they validate, but they must validate before continuing collection activities. If it was not being reported prior to them receiving your DV then I believe reporting to the CRA prior to validating would be a violation as that would be considered a collection activity.

Keep all the envelopes with the letters you receive too for the date it was mailed.
