Citifinancial has lost their mind !

On February 21st 2007 I sent out a request for Citifinancial to verify a debt via CMRR that is absolutly not mine. They sent me a letter back stating the following:

Thank you for contacting us regarding the payment information reported to the credit bureaus by CitiFinancial on the loan number referenced above. In response to your request to change the payment information reported, we have reviewed our payment records and we have determined the following.

The above referenced account has been sold to S&P Capital. We have updated your tradeline with CitiFinancial to reflect this transfer. The credit reporting agencies ask that you allow 30-45 days for the revision to be completed. Please retain this letter as confirmation of the change to be made to your CitiFinancial tradeline with the credit bureaus.

If you have any questions, please don't hesitate to call us at XXXXXXXXXX

** This is all I got, they never verified anything!

So, do I re-request verification ? I just feel that if I send a copy of my original request for verification along with this letter to the CRA, I may be stepping on my own toes..

Thanks in advance

First of all DV is for CAs/JDBs.

The BEST way to Dispute a listing with an OC is outlined here:

http://creditinfocenter.com/repair/DisputingWithOriginalCreditor.shtml

The debt is now sold to a CA. Make sure- when you recieve your first letter from the CA- that you do respond within the 30 day window. You know this debt does not belong to you- So make sure you are timely:

I say this because now that the debt is no longer in the hands of the OC and you may just get the ol' "you must speak with the CA" if you call the OC.

Whatever you do -don't speak to the CA, wait on a response to a DV

Sorry, I must have forgotten to mention, I did dispute the account with the CRA two times. The first time was 30 days before the first letter went to the OC and the second time was the same time I sent the second letter to the OC. I didn't DV CitiFi, I requested verification. Both times that I disputed the TL with CRA, they came back verified, yet when I look in Truecredit, the last reported date shows 05/2005...Anyway, I'm just having a tough time with this one..

Thanks again

When the CRA's verified, did you ask them their "MOV"? It would appear that since CitiFinancial no longer owns the debt, they would have had to verify with the current owner of the debt. If you have your reports from when they verified, contact them with that report number and ask them the how, when, and where method of their verification.xWhipMex

Im a newbie, so I have a few questions. Can you DV a CA if its an older account? Do they have to repospond the same with in 30 days? If they are suppose to DV in 30 days, what happens next if they dont DV? Do I send another CMRRR? I just need to know what to do next, I sent CMRRR on March 5 and they ony have till April 5th if they are suppose to DV

The new CA is First American Investment, this CA doesn't even have a bond to do business in Texas and they refused to sign for my CMRRR so I faxed them a DV and kept the fax reciept (I got the number from the Bud Hibbs site). The statement that they have under notes in Truecredit is "Unable to locate the consumer". The only place they show up is Experian and I disputed with them..I should find out if they verified in the next few days.

You can always DV a CA, but they don't have to cease collection activity. Some don't even respond, but I've had success DVing 1-2 years later.

Back to the OP, I agree with Thomas here. Disputing via the CRAs will get you nowhere, because they'll just come back and say 'verified'. Verified how? With who? If it's not your account, definitely ask for their method of verification as to how they ascertained this was yours. If it were me, I would get the BBB or AG involved, and I bet they would move then. They HATE that, and especially with the AG, they HAVE to respond. Usually it's within 10 days, too (at least in NC). They had better give the AG a very good reason as to why they are coming after you for this debt if it's not yours.

Faxes, even though it says confirmed, are still not as reliable. If they refuse to sign your certified request, keep a log of when it was returned to you and re-send it FedEx or UPS. There's more than one way to "skin a skunk"! :boxing:

Texas laws have teeth! You can crucify a CA and a CRA who violates.
