I just sued a creditor for FCRA violations in Small Claims court, I have a question.

Recommended Posts

I have sued an OC for multiple violations of the FCRA in my local small claims court.

Prior to this, I DV'd them, and asked them for a copy of my wet ink signature.

They told me that to release my signature, that I would have to sign a "release form".

In all of my dealings with OC's, I have never been asked to do this, I have been given statements, or nothing, or a signature etc.

I am concerned that maybe the OC is trying to get my signature, so that they can attach it to the contract and sue me.

So I didn't sign their request, and just went ahead and sued them for violations.

I then sent them a "settlement offer" and signed it. They came back at me with another letter indicating that they agree to my settlement offer, but want me to sign that document first, then they will sign the settlement offer and send me a check.

Any ideas on what to do?

This seems suspicious. VERY SUSPICIOUS.

Please help!

Thanks

But they haven't signed the settlement offer. They simply wrote me and asked me to sign a contract that would provide me with my alleged signature.

They said after I did that, then they would sign the settlement.

What do you think of that?

Tell them they can get your signature off the settlement agreement. Sign the settlement agreement in a manner totally different than your normal signature. Then, sit back and wait for it to show up on another document.
