Re-Aged Ass(es)!!!! Hurt my loan

OMG!!!!!!!!! I am so angry and really need help. I have worked so hard to get my credit cleared. I thought I was to the point I would be getting a new house which as a single parent who has struggled to me is a huge accomplishment. Not that it is the best of times because of the mortgage bankruptcies. Anyways, some of you have helped me with my battles and I had listed the one with one of my last 2 - a$$(es). Anyways, not only are theirs bs from 6 years ago, they arent even mine. They dont respond and have committed every violation known to man. They are still listed on one report. They are UCC -phone and electric and past the 3 year sol. I went to apply for a mortgage and guess what, those father-mothers re-aged them from 2001 to now say 2005 and open collections. Even though my scores are decent 670's 680's it appears recent and now have to put more money down which I cannot do. I am so pissed and as of now I cant move. What do I do? Do I draft a lawsuit, get a lawyer or god help me pay it? I need them off my CR but at this point they have already done the damage to me. I already tried before writing the ceo a letter and that did nothing but probably re-age it. How dumb are they. I have a dozen credit reports where they kept changing the dates and the ones from today. Not an honest mistake but obviously willful. I want to cry and need help.

Have you tried sending a DV? If they aren't yours they won't be able to validate. If you've tried that route it might be time to get the BBB, AG, or your own personal lawyer involved.

I would fight this battle before applying for a mortgage. Keep in mind depending on where you pull your credit from, the last reported date might look like re-aging but in fact may be the last time they updated the account. A direct pull from EQ should show the date of 1st delinquency, and this is the date that starts the 7 year reporting period.

thank you for the reply. yes I have disputed, dv, its many times. I have documented everytime. My scores are good and what they actually did was change again the dates to now be within the SOL. They have actually changed them 6 different occasions. I have the original hard copy CR and you can see each tieme the chaneg the date. Even the mortgage company has the report they faxed to me and it is chanegd to 2005 from 2001. That is willfull. The place I am living is being sold by the landlord and I have to move so I did everything I was supposed to and now this really hurts me and puts me in a bad spot becuase of their willful actions. I cant sleep and dont know what to do.

Make a copy of your communication with them, and make a complaint with the AG. The AG will give them 10 days to respond (at least in NC they do) and give you a copy of the complaint when they write them. They will most certainly provide an answer to the AG.

This just means the date it was assigned to the CA, not when it went delinquent. You need to ask the CRA what is the date of 1st delinquency. If your mortgage co is telling you that you can't get a mtg with this on there, then find a new one. People get mortgages with COs on their credit every day.

Kevins right.. go to a mortgage broker who can shop around for you.. this doesnt sound huge and should not prevent you from getting this home.. just because one underwriter has an issue with it doesnt mean they alll will

Thats what I am trying to say. They changed the deliquency date from 2001 to 2005 not the opened date. I argued the same thing myself then the MB faxed over the report and circled it for me showing they changed the status to open and the date to currently deliquent. My scores are "good" but with a current x2 collection they must be address or needs more money oop which I dont have.

I already sent it over to a broker not banker this time but his first statement was "current recent collections which must be resolved".

I am so angry and stressed I dont know what to do.

You will need to fight the DOFD or find a new broker, those are your only options. If you have proof send it to the CRAs. You say they list it as "opened". All COs are open until you pay them, so this is a misnomer. That still shouldn't stop you from getting a mortgage though.

Bottom line is, the CRAs don't make it easy to see just when an account went delinquent. They don't show the DOFD (when they should) and show other dates like 'Last Reported' which make a CO seem newer than it is. Really, a CO is a CO and shouldn't be "reported" every month.

Some CAs just update the comment field with something like 'charge off as of Jan, Feb, Mar 06'. Does that sound like a NEW update or just a way to make something APPEAR newer than it is? Hmmm....

Data Furnishers may send updated information at any time during the Reporting Period. WHEN they send the data in is reflected in the "Date Last Reported" field. This is not illegal re-aging. It IS the date that generates deductions to your score (on derogatory accounts).

A CA may, and properly should, report the date they acquired the account in their tradeline's "Date Opened" field. This also does not constitute illegal re-aging.

Numerous problems with the subprime mortgage market right now are causing lenders to tighten up. Unless your CA's are medical in nature, they most likely must be dealt with. In the old days a consumer could pay them at closing. Try asking a broker for that and see if payment can be factored into your deal (depending on the amounts).

I thank you for the post. I have read and re-read the posted advise from everyone. i will tell you what the most damning piece of information I discovered. The tip off this is not an innocent mistake which although may be plausible is not probale has to do with how long these will report until. The date of reporting until has also been changed (updated) from 2007 or 2008 depending on which one and extended to now reflect 2012 which in my opinion does corroborate the re-aging. That is the most damning piece of information I found.

the thing is my scores are actually now above the subprime level it is the marketplace standards which are hurting me but specifically the response was "the two recent current collections" which are neither. That is th eissue and how I address it. thank you.

I have nothing absolute. But I do have several CR where the dates have changed as well as the date scheduled to appear until on the most recent have changed (been extended). Teh only way that could be is if they re-aged? Correct? If that's all I need, I have already tried sending this to a lawyer for review but as of yet received no reply either way. I was just wondering is I should send them a letter pointing out their actions as ITS? I did before and it got me them changing the dates to extend it.
